Famous Interiors — Terms and Conditions


Introduction


By accessing or using the Famous Interiors website (including the app, mobile site, and our social media pages) (collectively the "Website"), you agree to these terms and conditions ("Agreement") and our Privacy Policy. This Agreement is between you and Famous Interiors Pty Ltd trading as Famous Interiors (referred to as "we", "us" or "our"). We may update these terms at any time by posting the revised version on the Website. Continued use of the Website after changes are posted means you accept those changes.


Account Registration and User Requirements


  • You must register an account to place orders and to use certain Website features. When registering you will provide personal information such as your full name, postal address, and a working email address. You are responsible for keeping this information accurate and up to date.
  • By using the Website you expressly consent to receiving marketing and transactional messages from us at the email address you supply; you may opt out of marketing messages at any time. Some communications (for example cart reminders) may be implied by your use of certain Website functions.
  • To open an account and use the Website you must be at least 18 years old, have a current residential address in Australia, and have the legal capacity to enter into a binding agreement.


Access and Use of the Website


You must access and use the Website only via the interfaces and methods we provide and in compliance with this Agreement and applicable law.

You must not (nor attempt to):

- disrupt, impair or damage the Website or the servers/networks that host it;

- use data mining, bots, screen scraping or similar automated tools to extract data from the Website;

- bypass or interfere with security or other protective features of the Website; or

- copy, reproduce, distribute or use content from the Website without our prior written permission.

We may report fraudulent, abusive or illegal activity to law enforcement or other authorities. You are responsible for all activity on your account (including orders placed) and must keep your password and login details secure. We are not liable for unauthorized activity if you do not adequately protect your login credentials.

You must not use another person’s account without our and that person’s permission. If you suspect unauthorized access to your account you must notify us immediately and take steps to secure it (for example change your password).

We do not promise the Website will always be available or free from interruptions, nor do we endorse or warrant content on other websites linked from our Website.


Information on the Website


Product information on the Website is supplied by third party sellers, manufacturers and suppliers. Except as required by law (including the Australian Consumer Law) we are not responsible for inaccuracies or errors arising from information provided by these third parties.

You should independently verify product details and suitability before ordering.

Because of photography and screen display variances, the actual goods may differ slightly in appearance (for example colour) from what is shown online. Some images or descriptions may be selected or produced for promotional purposes and may not be an exact representation of the product you receive.


Disclaimer and Limitation of Liability


To the maximum extent permitted by law, we exclude all liability to you and third parties for any loss, damage or expense of any kind in connection with the Website, including but not limited to loss or damage resulting from:

- errors, inaccuracies or omissions on the Website or our social media pages;

- reliance on information found on the Website or linked sites;

- personal injury or damage to property arising from use of the Website;

- unauthorised access to, or use of, our secure servers or the personal/financial information stored on them;

- interruption or failure of transmission to or from the Website;

- viruses, malware or other malicious code transmitted through the Website by third parties; and

- the quality or suitability of products or services on linked sites.

We do not warrant, endorse or guarantee products or services sold by third parties via the Website and we are not responsible for monitoring transactions between you and third-party merchants.


Where applicable law (including the Australian Consumer Law) provides guarantees that cannot be excluded, our liability is limited to the extent required by that law.

Except where required by law, in no circumstances will we or our affiliates, officers, employees or suppliers be liable for any indirect, special, incidental or consequential loss arising from or in connection with the Website or this Agreement. You accept responsibility for ensuring that your actions are lawful where you are located; we are not responsible for the legality of your conduct.

If you require insurance or need a merchant or service provider to have insurance that covers you, it is your responsibility to check and obtain any such insurance before booking or purchasing. Famous Interiors accepts no liability in respect of insurance arrangements.


Indemnity


You agree to indemnify and hold us, our directors, officers, employees and agents harmless from and against any loss, liability, costs (including reasonable legal fees) or expenses arising from any claim, demand, action or proceeding brought by any person that results from your breach of this Agreement or your actions.


Placing Orders


You are responsible for all orders placed through your account and for errors in those orders caused by you.

Product listings or promotions on the Website are invitations to treat and are not binding offers to sell.


When you place an order you make an offer to buy:


A voucher for goods/services subject to these terms and any third-party supplier terms at the price shown (including delivery and other charges); or

- goods under these terms at the price shown (including delivery and other charges).

Items in your cart are not reserved until checkout is completed and payment has been received in full.

We use automated fraud detection and this may delay or result in cancellation of your order. If flagged for potential fraud we may investigate and, at our discretion, cancel and refund your order.

We may refuse or cancel an order if we suspect credit card fraud, if we cannot fulfill the order, or if there is an error in the price or description on the Website.

Please check your order carefully before placing it. Once confirmed, orders cannot be cancelled or changed except in accordance with our returns policy. Change-of-mind returns are granted at our discretion and, generally, we will not change or replace an order if the mistake was made by you.

If we cancel or cannot fulfil your order we will refund any payment received in full.

If goods you ordered become unavailable for reasons beyond our control we may offer a full refund or store credit (your choice).


Pricing, Payment and Discount/Coupon Codes


Prices and charges shown are in Australian dollars.

Payment must be received in full before we dispatch goods or issue vouchers. If payment is not received or is declined by your bank or payment provider we cannot reserve items.

A discount code is valid for a single transaction only and cannot be used with other discounts unless expressly stated.


Store Credit


Any unused portion of store credit will remain on your account.

To the extent permitted by law, we may change store credit terms with reasonable notice, including by posting changes on the Website.

Store credit issued instead of a refund expires 12 months from issue. Promotional or discretionary store credits (including goodwill credits) expire after 3 months unless otherwise stated.


Change-of-Mind Returns


If items are unused, uninstalled, and in a fully resalable condition (unless faulty or custom-made), you may return or exchange them for a full refund within 365 days, subject to the following:

- Items must be unused, in their original packaging and resalable in the same condition as received.

- Customised or specially made items are not eligible for return, refund or cancellation (examples include custom-cut stone tops, cut-to-size items, custom vanities, some shower screens, spa baths, and similar bespoke products).

If a return is accepted, you must follow our returns procedure as set out in our Return Policy.

You are responsible for return postage. Bulky and fragile items must be packaged securely for return; you are liable for any damage caused during return transit. Refund amounts may be adjusted based on the condition of returned items.


Defective Goods and Warranties

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You have rights to a replacement or refund for major failures and compensation for reasonably foreseeable loss or damage, and you may be entitled to repair or replacement for other failures.

Any warranty we provide is in addition to rights under applicable law. Where applicable, you may claim under our Warranty Terms & Conditions.

Some products carry both a supplier warranty and a separate warranty from us. If a supplier does not approve a warranty claim but our warranty applies, we will still handle the claim. If you are unsure how to claim for a faulty item, contact our Aftersales team.


Returns and Refunds Process

To request a return, contact us using the Return & Exchange Form or via Customer Support (email or online chat). We will assess your request and, if appropriate, provide a Return Authorisation and instructions which you must follow.

Returned items will be inspected and we will determine whether a remedy applies. If we determine no remedy is appropriate (for example because of misuse or failure to follow instructions), we will reject the claim and return the item to you. You must pay the return postage to receive goods that are rejected on inspection; we will provide instructions on how to pay.

Refunds will be returned to the original payment method. Store credits will be applied to the account used to buy the goods.

We aim to process refunds or replacements within 28 days of receiving the returned item; some cases may take longer depending on the item or volume of returns.

If goods or services are redeemable through a third-party provider, the refusal of a refund or store credit from us does not prevent you from seeking a refund directly from that provider.


Storage Fees for Extended Storage


Standard storage is free for up to 2 months.

If items remain in storage beyond 2 months, extended storage fees apply:

- Third month: 5% of the original storage cost;

- Fourth month: 10% of the original storage cost;

- Fifth month: 10% of the original storage cost;

- Sixth month: 10% of the original storage cost.

We will notify you before the end of the 2-month period about upcoming charges. Extended storage charges will be added to your account and must be paid before shipment or pickup. You may collect items anytime during the extended storage period; charges will be prorated for partial months.

If items remain in storage for more than 6 months without payment, we may take actions at our discretion, which may include disposing of the items in accordance with applicable law.


Unbeatable Price Guarantee (UPG)

Our Unbeatable Price Guarantee applies to identical products found online that are in stock and available. When comparing prices, we take into account any delivery costs to your location, where applicable. If a competitor’s identical in-stock product can be purchased and delivered to your location at a lower total cost than our price, we will beat that total cost by 5%. The 5% UPG discount cannot be combined with any other offer.

Qualifying items for the 5% reduction must:

- have the same SKU as the item we stock;

- be in stock and available at the competitor’s store; and

- not be excluded by the UPG exclusions below.

Exclusions from UPG:

- Cashback, coupon or discount code offers (including supplier cashback or paper/electronic coupons);

- Commercial or trade pricing and quantities not available to the general public;

- Stock liquidations, clearance items or products from businesses in receivership;

- We reserve the right to limit sales to reasonable retail quantities.

The 5% UPG discount cannot be used with other offers.
